All orders will be made subject to these FM-Tags terms and conditions of sale. Every effort is made to ensure this web-site is totally accurate, however, we reserve the right to revise, re-quote, correct errors or refuse orders at our discretion. You will be informed if there is an error in price discovered in the goods of which you have ordered.
Without notice FM-Tags Ltd reserves the right to discontinue any product, service or to make design changes as part of the on going improvements, or to assist availability of products ordered.
Quotations and tenders by FM-Tags Ltd shall not constitute offers and FM-Tags reserves the right to withdraw or amend the same at any time prior to acceptance of the Customers order.
PROCESSING TIMESCALE FOR PLAQUES :
The delivery timescale will be advised on order only.
FM-Tags Ltd aim to process and deliver products within the guided timescale. These are a guided timescale and although best efforts will be made by FM-Tags Ltd, FM-Tags Ltd will not be held liable for any delays. At the discretion of FM-Tags Ltd a discount or the delivery charge maybe refunded to the customer.
Delivery charges specified are for UK mainland. These areas may incur an additional delivery charge
- UK islands, e.g. Isle of Wight, Jersey, Isle of Jura, etc.
- Northern Ireland.
- Parts of the Scottish Highlands.
- Parts of Scotland.
FM-Tags Ltd may charge extra delivery if at the request of the customer for instalment deliveries.
The majority of our products are dispatched 1st Class Recorded Royal Mail. If you have not received your items, you must check with your local sorting office even if you have not received notification from your postman that they are holding items for you.
Unless otherwise stated plaque prices are exclusive of VAT. FM-Tags Ltd reserves the right to revise stated prices to take account of any changes in rates of duty, carriage, freight or insurance and raw material cost. Material and service invoices are quoted Nett. Unless specifically stated to the contrary. Where a credit account has not been agreed FM-Tags reserves the right to send all debts to a third party for payment collection where interest on all overdue money and a administrative fee will be charged. All payments should be made by online banking or bacs transfer.
Where FM-Tags Ltd supplies or offers goods in accordance with the Customers own design(s) or specification(s) then the customer shall fully indemnify FM-Tags Ltd against all claims action penalties costs and expenses to which FM-Tags Ltd may become liable arising therefrom involving infringement of a patent, registered design, trade mark or trade name.
CANCELLATIONS & RETURNS
For most items, you have the legal right to cancel your order within 14 working days of receiving the goods. However, this does not apply to certain items, which we have made, personalised or customised specifically for you. It does not apply to any goods, which have been opened or used. Order cancellations must be made in writing, quoting your order number, within 14 working days beginning the day after the day on which the item is delivered. If you wish to cancel your order you can notify us by email to firstname.lastname@example.org or by telephone (01293 862673) before we have dispatched the goods to you or: Where goods have already been dispatched to you, the goods must be returned to us in as new condition or unopened. You may be subject to a 25% handling charge. Post & Packaging charges will not be refunded.
Please note: In order to provide a fast service some products are immediately sent for production. Please check your order carefully as we do not refund personalised or customised products.
We reserve the right to cancel your order at any time and issue a full refund. The provisions of this clause do not affect your statutory rights.
If the item received is faulty, mis-spelt or incomplete please contact us by email quoting your order number, your name and address, details of the product and the reason, and whether you require a refund or a replacement. We will then advise on how to proceed.
The easiest way to resolve any problems that you may experience is to speak to FM-Tags Ltd direct. They will ensure that any issues are investigated and were possible rectified. FM-Tags Ltd shall not be liable for any defects in the quality nature or conditions of the goods or for failure of the goods to comply with any specification or shortage in quantity delivered unless a claim in writing shall be lodged with FM-Tags Ltd by the customer within 7 days of delivery of the goods. In the event of any defect, failure or shortage as aforesaid which is duly notified to FM-Tags Ltd in accordance with the conditions of above shall be replaced free of charge. FM-Tags Ltd shall not be held liable in any event for any loss arising out of the exercise or its discretion in accordance to the above. FM-Tags Ltd shall not be held liable for any claim or claims for direct or indirect consequential or incidental injury loss or damage made by the customer against FM-Tags Ltd. Without prejudice to the foregoing FM-Tags Ltd’s liability for any loss or damage shall not in any event exceed the contract price for the goods. All processing of or any work done on the customer's material is entirely at the customer's risk and FM-Tags Ltd accepts no liability for damage to such material howsoever arising and the customer shall indemnify FM-Tags Ltd against all damages penalties costs and expenses to which FM-Tags Ltd may become liable as a result of the use of such material.
In the event of any circumstance if beyond there reasonable control of the Company shall have the right either to suspend deliveries without notice or cancel any orders placed without liability. This by ways of illustration but without limitations : Strike, Lockout, Riot, war, epidemic, fires, failure of a supplier, machine breakdowns or other causes, whether similar or not.
LAW & ARBITRATION
The contract of Sale is governed by English Law. All differences and disputes arising between FM-Tags Ltd and the customer under or in respect of or out of or in connection with this contract shall at the option of FM-Tags Ltd but not otherwise be referred to Arbitration in England by a British Arbitrator to be agreed between the parties or in default of agreement (within 7 working days after notice being given by FM-Tags Ltd to the customer requiring the customer to agree to the appointment of a particular Arbitrator) to be appointed by the president of the London Chamber of Commerce in accordance with the Arbitration Act 1950 or any statutory variation, modification or re-enactment thereof for the time being in force. If FM-Tags Ltd exercises its option aforesaid an award of the said Arbitration shall be a condition precedent to any liability of FM-Tags Ltd to the Customer.
